What is an Enduring Guardian?

An enduring guardian is someone you choose to make personal or lifestyle decisions for you when you can't make decisions for yourself. These appointments are usually made when you are physically or mentally incapable of making decisions for yourself.

The enduring guardian will only become active once you are unable to make a decision for yourself. The guardian must act within the principles of the Guardianship Act, in accordance with the law and in your best interests. A Guardian cannot make your will

An Enduring guardianship will end in the following circumstances:

  • You die
  • You revoke the guardianship
  • You marry
  • If one of your joint guardians dies, becomes incapacitated or resigns
  • The guardian Tribunal revokes the appointment
